  • Electricity Authority of Viet Nam

    Electricity Authority of Viet Nam (EAV) is an organization under the Ministry of Industry and Trade (MOIT), which helps the Minister of MOIT to perform the state management and law enforcement in the power sector, power regulation activities, including: power development planning, investment in power projects; development of renewable energy, new energy; competitive electricity market, electricity price and electricity trading activities; national power system dispatch; issuance of electricity licenses; organizing and managing public service activities within the scope of management of EAV in accordance with the provisions of law and the decentralization and authorization of the Minister of MOIT.

    EAV has its own legal status, seal and account in accordance with the provisions of law; its operating funds are provided by the state budget and from other sources in accordance with the provisions of the State.

    Duties and Powers

    1

    To formulate and submit to the Minister of MOIT for promulgation according to his/her competence or for the Minister of MOIT to submit to competent authorities for promulgation of:

    • Legal documents and schemes in the assigned fields of state management;
    • Power development plans, adjustments to power development plans in accordance with the law on planning; lists of power projects exclusively invested, built and operated by the State; strategies and policies for electricity trade with foreign countries;
    • Mechanisms and policies to encourage and ensure the development of electricity and renewable energy; mechanisms for adjusting the average retail electricity price;
    • Methods for determining prices of electricity generation, wholesale electricity, and generation costs; methods for establishing electricity import price frameworks; procedures for approving price frameworks for generation, wholesale, transmission, distribution, and other services;
    • Approval of price frameworks for electricity generation, import, wholesale, and various service charges in the power sector;
    • Regulations on the competitive electricity market, restructuring of the power sector, direct power purchase agreements, and the development of the forward electricity market;
    • Regulations on the dispatch and operation of the power system, including incident handling, black start, and system restoration; regulations on transmission, distribution, and metering systems;
    • Regulations on electricity activity licenses;
    • Regulations on violations and forms of handling violations of the law in the assigned fields of state management;
    • Solutions to improve the efficiency of state management in implementing power development plans, investing in power projects, and developing the competitive electricity market;
    • Digital transformation activities; developing plans and resources for the management and development of the Vietnam Energy Information System.

    To formulate and submit to competent authorities for promulgation or recognition for application of technical regulations, national standards, and techno-economic norms for power construction projects.

    To guide, inspect, and propose amendments to legal documents, strategies, and plans related to the power sector; to handle violations of the law in the power sector.

    To advise and assist the Minister of MOIT in exercising state management over construction investment in power development projects:

    • To appraise and submit for approval investment policies, feasibility study reports, and construction designs; to inspect the acceptance of power projects;
    • To organize the selection of investors for BOT power projects, negotiate, and submit project contracts for signing; to manage and inspect the implementation of these projects;
    • To propose investment policies for renewable and new energy projects in inter-regional sea areas; to provide opinions on investment conditions and transfer of projects involving foreign investors;
    • To synthesize information, data from monitoring primary energy sources, and statistics on the electricity output of large-scale renewable energy power plants.

    To perform tasks related to electricity regulation:

    • To appraise, grant, amend, supplement, re-grant, extend, and revoke electricity activity licenses under the authority of MOIT;
    • To organize the appraisal of various electricity prices and service charges;
    • To inspect the implementation of electricity price adjustments by Vietnam Electricity and other power utilities; to ensure transparency in electricity pricing;
    • To appraise and submit for approval the annual power system operation methods and competitive power market operation plans;
    • To propose programs for smart grid development and national programs on demand side management;
    • To exercise state management over the command and operation of the national power system.

    To perform the functions of a specialized construction agency under MOIT for works and projects in the power sector.

    To carry out specialized inspection tasks on the contents under the assigned state management functions.

    To preside over the implementation of the rights, responsibilities, and obligations of the state owner with respect to the National Power System and Market Operator (NSMO).

    To carry out international cooperation and manage cooperation projects, grants, and support from international organizations and foreign governments.

    To review, systematize, consolidate, and codify legal documents.

    To organize propaganda, dissemination, and communication of legal documents, guidelines, and policies on power development.

    To build, operate, and administer the information systems, data, and electronic portals of the Authority.

    To research and apply scientific and technological advances in the field of electricity and electricity regulation.

    To be entitled to request relevant organizations and individuals to provide necessary information and documents for the performance of assigned tasks.

    To organize consultancy, training, and human resource development in fields related to electricity activities.

    To carry out legal affairs and administrative reform in the assigned fields.

    To manage the organizational structure and payroll; to implement salary regimes and policies for officials and public employees.

    To manage assigned finances and assets in accordance with the law.

    To advise on state management and monitor the activities of professional associations operating within the assigned industry and field.

    20

    To coordinate with the Office of the National Steering Committee for Power Development.

    21

    To perform other tasks assigned by the Minister of MOIT.
